On 14 November 2018, the UK government published a draft agreement on the UK’s withdrawal from the EU, including a Protocol on Northern Ireland
The document seeks to establish a transition period from the date of entry into the Agreement, until 31 December 2020. It also details further options to extend the period, on agreement of the Joint Committee, if decided before 01 July 2020.
During the transition period, Union law will remain applicable in the UK, meaning that parties seeking to place plant protection products and biocides on the UK market will still need to abide by the requirements of the respective EU product regulations, as well as REACh and CLP. The agreement does not contain details of the UK regulatory landscape post the transition period.
It is confirmed that the draft Agreement will be presented to UK Parliament for voting on 11 December 2018, following legal reviews and translation into all EU MS languages. In the event the deal does not pass parliamentary vote, the UK could move closer to a ‘no deal’ Brexit.
